YOURCHECK, INC. PRIVACY POLICY

1. Introduction

This Privacy Policy describes the information practices of YourCheck, Inc. (also referred to as “YourCheck,” “we,” “us,” or “our”) on the YourCheck website at yourcheck.co (along with all subdomains, collectively, the “Site”). This Privacy Policy is only applicable to the Site and not to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

NOTICE TO CALIFORNIA RESIDENTS: Additional privacy policies, specifically developed and maintained for California residents, are found within this Privacy Policy. If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. To learn more about your California privacy rights, a link to the sections within this Privacy Policy relating specifically to California residents is found in the section entitled California Privacy Rights Notice.

2. Information Collection Practices

Protecting your privacy is paramount to YourCheck. We will strive to use care when handling personal data to ensure we have complied with the industry’s privacy best practices, applicable laws, including the European Union’s General Data Protection Regulation (“GDPR”) or similar statute, and terms of the Apple Developer Program License Agreement. YourCheck will not collect your or your usage data without your consent or otherwise complying with data privacy laws.  We will not compile personal information from any source that is not directly from the user or without your explicit consent, including public databases. Data collected from us will only be shared with third parties to improve the app or serve advertising (in compliance with the Apple Developer Program License Agreement). If you do not want us to share your Personal Information with any third parties, please email us at legal@yourcheck.co or select the “opt-out” box on our online forms. 

i. Types of Information Collected

Personal Information Collected. In order for you to access and purchase products offered via the Site, we may request you to provide information that personally identifies you (“Personal Information”). Personal Information may include the following categories of information: (1) Contact Data (such as your name, mailing address, and e-mail address); (2) Financial Data (such as your account or credit card number); and (3) Demographic Data (such as your zip code and age). If you communicate with us by email, post messages to any of our chat groups, bulletin boards, or forums, or otherwise complete online forms, surveys, or contest entries, any information provided may be collected as Personal Information.

Traffic Data Collected. We may automatically track and collect the following categories of information when you visit our Site including: (1) events data including: (i) Internet Protocol (“IP”) address, (ii) access times, (iii) browser type and language, (iv) Internet Service Provider (“ISP”), (v) the pages you visit on our Site, (vi) the Content you view on our Site and (vi) the URL of the page that you referred you to our website; (2) domain servers; and (3) types of devices accessing the Site; and (4) (collectively “Traffic Data”). 

We do not use information from Contacts, Photos, or other APIs that access your user data to build a contact database for our own use or for sale/distribution to third parties, and we do not collect information about which other apps are installed on a user’s device for the purposes of analytics or advertising/marketing. We also will not contact people using information collected via a user’s Contacts or Photos, except at the explicit initiative of that user on an individualized basis. Data gathered from the HomeKit API, HealthKit, Consumer Health Records API, MovementDisorder APIs, ClassKit or from depth and/or facial mapping tools (e.g., ARKit, Camera APIs, or Photo APIs) will not be used for marketing, advertising or use-based data mining, including by third parties.

ii. Uses of Information Collected

We may use the information collected through the Site to provide services on the Site and related functionality and services. The collected information may be used for a variety of activities, including:

Use of Information

  • Operate, maintain and improve the Site and its services;
  • Enable you to access and use the Site;
  • Send you notices, updates, security alerts and support and other messages;
  • Provide and deliver the services and features you request, process, and complete transactions, and send you related information, including purchase confirmations and invoices;
  • Respond to your comments, questions, and requests and provide customer service and support;
  • Monitor and analyze trends, usage, and activities in connection with the Site and services it provides and for marketing or advertising purposes;
  • Investigate and prevent suspicious or fraudulent transactions, unauthorized use of the Site and other illegal activities;
  • Personalize and improve the Site, and provide content, features, and/or advertisements that match your interests and preferences;
  • We will send you push notifications in order to update you about the Site’s offerings. If you no longer wish to receive these types of communications, you may turn them off on your browser via Account > Settings > Privacy or device in the app via Settings > Privacy. To ensure you receive proper notifications, we collect certain information about your device such as operating system and user identification information;
  • Link or combine with other information we receive from third parties to help understand your needs and provide you with better service;
  • We use your Financial Data only to verify your qualifications for specific products or services and bill you for products and services. We do not use your Financial Data for any other purpose; and
  • For other purposes about which we notify you or are essential to the Site’s functionality.

Processing of Your Information

By accessing or using the Site and its services or otherwise providing information to the Site, you consent to the processing and transfer of information in and to the U.S. and other countries and territories, which may have different privacy laws from your country of residence. With your consent, we may use your Personal Information to send you information about our company and our products or services or to contact you when necessary. We may also share your Personal Information with our partners who may contact you about goods and services they offer. 

iii. Cookies and Web Beacons

Cookies and web beacons are small text files that are stored on your computer when you visit certain web pages. YourCheck collects information through cookies and web beacons about your web browsing activities such as the address of the page you are visiting, the address of the referrer page you previously visited, the time you are viewing the page, your browsing environment, and your display settings. We may use cookies and web beacons on our Site for the following purposes:

  • Understanding traffic patterns and the number of visitors to the Site and other websites that we partner with;
  • Understanding how you use and interact with the Site;
  • Improving YourCheck products and services;
  • Optimizing your experience on the Site;
  • Providing anonymous individual or aggregated auditing, research, modeling, and reporting for our advertisers and other partners;
  • Storing your password, so you do not have to re-enter it each time you visit the Site;
  • Providing you with relevant advertising and content; and
  • Managing our Site.

Please note that cookies may be placed by a third-party service provider who performs these functions for us. These third parties may have their own privacy policies.

iv. Sharing of Personal Information

We may share Personal Information with advertisers and other third parties. The other parties with whom we share Personal Information may send information to you about products or services. We do not share your Financial Data with these third parties. We may share Financial Data with business partners who assist us by performing core services (such as hosting, billing, fulfillment, or data storage and security) related to our site’s operation. Those business partners agree to uphold the same standards of security and confidentiality described in this Privacy Policy, and they will only use your Financial Data to carry out their specific business obligations to YourCheck.

If you do not want us to share your Personal Information with any third parties, please email us at legal@yourcheck.co or select the “opt-out” box on our online forms. In addition, we maintain a procedure for you to review and request changes to your Personal Information, described below.

v. Internet Based Ads

We may also share Traffic Data with advertisers and other third parties who may use it for advertising purposes, including to serve targeted advertising on non-affiliated third party sites. These companies may utilize cookies, pixels or other technologies to collect user information (e.g., hashed, de-identified data, click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to this and other websites in order to provide advertisements about goods and services likely to be of greater interest to you. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information about your online activities on the Site or other websites over time. For example, anonymous information collected across multiple sites may enable the ad network to predict your preferences and show you ads that are likely to be of interest to you. Please note that we do not share any information that identifies you personally with the third-party service providers who serve ads on our behalf. If we or some or all of our assets are acquired by another company, including through a sale in connection with a bankruptcy, that company will possess the information collected by us, and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

We may disclose Personal Information or other data to comply with the law or legal requirements, enforce or apply our Terms of Use and other agreements, or protect our rights, property, the safety of our users, or others.

vi. Email Marketing

By submitting your email address via the Site, you are expressly consenting to receive emails from YourCheck, Inc., including from YourCheck’s affiliates, and third parties concerning offers and advertisements unrelated to YourCheck.  To unsubscribe from receiving email messages from us, from our affiliates or other third parties, click on the “Unsubscribe” link contained in each email.

vii. Contests, Sweepstakes, Surveys

YourCheck may conduct or co-sponsor contests, sweepstakes, or other offerings. In such circumstances, the information we obtain from you may be shared with our co-sponsor. Our co-sponsors will have the right to use your information for their own purposes, in accordance with their own privacy policies. If you do not wish for the information we obtain from you to be shared with our co-sponsor, please do not participate in these offerings.

viii. Testimonials

We publish testimonials provided by our satisfied customers on our Site in addition to other endorsements. If you provide a testimonial, we may publish it on our Site using your first name and last initial.

3. Confidentiality and Security of Personal Information

i. User Ability to Access, Update, and Correct Personal Information

At any time, you may contact YourCheck via email at legal@yourcheck.co to update your Personal Information or request that your Personal Information no longer be shared by YourCheck. In the case that your credit card, user name, or password is lost, stolen, or used without permission, promptly contact YourCheck at legal@yourcheck.co to update the Personal Information we have on file for you. We will respond to access requests within 30 days.

If you wish to deactivate your account, please email us at support@yourcheck.co, but note that we may retain information as required by law or for legitimate business purposes. We may also maintain cached or archived copies of your information. We will retain your information as needed to provide you services and to process your information as requested by you. We will retain and use your information to comply with our legal obligations, resolve disputes, and enforce our agreements. We will retain your personal information as necessary to comply with legal obligations, resolve disputes, and enforce agreements.

ii. Security

YourCheck uses reasonable security measures to protect against the loss, misuse, and alteration of the information under YourCheck’s control.

4. Public Information

The Site contains links to websites not operated by YourCheck. We are not responsible for the privacy practices or the content of such websites. Please review the privacy policies of each site you visit. We may also make chat rooms, forums, message boards, and news groups available to you. Please understand that any information that is disclosed in these areas becomes accessible to the public. You should exercise caution when deciding to disclose your Personal Information in a public forum.

5. Updates and Changes to Privacy Policy

We reserve the right, at any time and without notice, to update or modify this Privacy Policy, simply by posting such update or modification on the Site. Any such change, update, or modification will be effective immediately upon posting on the Site. Your consent to such changes through your continued use of the Site.

California Privacy Rights Notice

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in the Privacy Policy of YourCheck, Inc. (also referred to as “YourCheck,” “we,” “us,” or “our”) on the YourCheck’s website at yourcheck.co (along with all subdomains, collectively, the “Site”). This PRIVACY NOTICE applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”).

The State of California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. YourCheck may make your Personal Information available to third parties for their marketing purposes as described in this Privacy Policy. If you do not wish to share your information in this way, send your request to support@yourcheck.co.

Additionally, this notice is adopted to comply with the California Consumer Privacy Act of 2018 (“CCPA”) (Civil Code Section § 1798.100 et seq.), as may be amended or supplemented, and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

YourCheck’s Site and normal business operations collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device, including but not limited to identifying information (collectively, “personal information”). In particular, YourCheck may collect the following categories of personal information from consumers:

  • Directly from our customers or their agents. For example, from information that our customers provide to us related to the services for which they engage us.
  • Indirectly from our customers or their agents. For example, through information, we collect from our customers in the course of providing services to them.
  • Directly and indirectly from the activity on our website (yourcheck.co) along with all subdomains. For example, from submissions through our Site portal or Site usage details collected automatically.
  • From third parties that interact with us in connection with the services we perform.
Use of Personal Information
 
We may use or disclose the personal information we collect for one or more of the following business purposes:
 
  • Operate, maintain and improve the Site and its services;
  • Enable you to access and use the Site;
  • Send you notices, updates, security alerts and support and other messages;
  • Provide and deliver the services and features you request, process, and complete transactions, and send you related information, including purchase confirmations and invoices;
  • Respond to your comments, questions, and requests and provide customer service and support;

  • As necessary or appropriate to protect the rights, property, or safety of us, our customers, or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.
YourCheck will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
 
Sharing of Personal Information
 

YourCheck may disclose your personal information to a third party for a business purpose. We do not share your Financial Information with third parties but we may share Financial Data with business partners who assist us by performing core services (such a hosting billing, fulfillment, or data storage and security) related to our operation of the Site. When we disclose personal information for a business purpose to third parties or Financial Data with business partners, those third parties and business partners agree to uphold the same standards of security and confidentiality described in this Privacy Policy, and Financial Data will be used only to carry out specific business obligations to YourCheck.

We disclose your personal information for a business purpose to the following categories of third parties: 

  • Our affiliates.
  • Service providers.
  • Third parties to whom you or your agents authorize us to disclose your personal information in connection with products or services we provide to you.

Disclosures of Personal Information for a Business Purpose

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:
 
  • Category A: Identifiers.
  • Category B: California Customer Records personal information categories.
  • Category C: Protected classification characteristics under California or federal law.
  • Category F: Internet or other similar network activity.

Sales of Personal Information

In the preceding twelve (12) months, YourCheck has not sold any personal information.
 
Your Rights and Choices under the CCPA
 

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights
 
You have the right to request that YourCheck disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we received and confirm your verifiable consumer request, we will disclose to you:
 
  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  • sales, identifying the personal information categories that each category of recipient purchased; and
  • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion Request Rights
 

You have the right to request that YourCheck delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to: 

  • 1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • 2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • 3. Debug products to identify and repair errors that impair existing intended functionality.
  • 4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • 5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • 6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.
  • 7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • 8. Comply with a legal obligation.
  • 9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability, and Deletion Rights
 
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either: via email (legal@yourcheck.co) or U.S. Mail (YourCheck, Inc., Legal Department, 215 W. Michigan Ave, Ypsilanti MI 48197).
 
Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
 
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
 
  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
 
Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. For instructions on exercising sale opt-out rights, see Personal Information Sales Opt-Out and Opt-In Rights, below.
 
Response Timing and Format
 
YourCheck will endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
 
If you are a current customer of YourCheck, we will deliver our written response to the contact information we have on file for you. If you are not a current customer, we will deliver our written response by mail or electronically, at your option.
 
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
 
YourCheck will not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
 
Personal Information Sales Opt-Out and Opt-In Rights
 
If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). YourCheck does not sell the personal information of consumers we actually know are less than 18 years of age as YourCheck’s Terms of Use state that if you are under 18 years of age, or if you are not the age of majority in your jurisdiction of permanent residence, you must leave the Site immediately. Consumers who opt-in to personal information sales may opt-out of future sales at any time.
 
To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by email (legal@yourcheck.co) or U.S. Mail (YourCheck, Inc., Legal Department, 215 W. Michigan Ave, Ypsilanti MI 48197).
 
Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back into personal information sales at any time by emailing YourCheck at legal@yourcheck.co.
 
You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
 
Non-Discrimination
 
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
 
  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
